By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

SERVICES OVERVIEW

Peeko AI provides tools that help brands understand and improve how AI tools and AI agents discover, interpret, and use their brand, product, catalog, and specification information. The Services may include AI visibility dashboards, brand and product analysis, recommendations, reporting tools, and access to MCP-connected workflows that make product information easier for AI agents to evaluate and use.

ELIGIBILITY

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

USER ACCOUNTS

To access certain features of the Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, and notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if we suspect unauthorized, fraudulent, or abusive activity.

ACCEPTABLE USE

You agree not to use the Services to:

Upload, transmit, or distribute content that is harmful, threatening, abusive, defamatory, or otherwise objectionable

Misuse the MCP server, APIs, or integrations in a way that exceeds authorized access or harms other users

INTELLECTUAL PROPERTY

All content, features, software, dashboards, workflows, recommendations, reports, interfaces, logos, and functionality of the Services are owned by Peeko AI or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of our Services without our prior written consent.

You retain ownership of any data, content, product information, catalog information, specifications, or other materials you provide to the Services. By using the Services, you grant us a limited license to process, analyze, display, and use that information solely to provide, maintain, secure, and improve the Services.

AI-GENERATED CONTENT AND RECOMMENDATIONS

The Services may use artificial intelligence to generate analysis, summaries, recommendations, reports, or other outputs. AI-generated outputs are provided on an "as-is" basis. You acknowledge that:

AI outputs may not always be accurate, complete, current, or error-free

You are responsible for reviewing and verifying any AI-generated content before relying on it

We do not guarantee that any recommendation will improve visibility, ranking, traffic, sales, specification outcomes, or business performance

The Services do not replace your own business, technical, legal, compliance, or professional judgment

MCP SERVER AND INTEGRATIONS

Peeko AI may provide access to an MCP server or MCP-connected workflows that allow authorized AI agents, applications, or tools to interact with certain product, catalog, or specification information. You are responsible for ensuring that any information you provide or authorize for use through MCP-connected workflows is accurate, appropriate, and permitted to be shared.

We may limit, suspend, or revoke access to MCP-related features if we believe they are being misused, create security risks, violate these Terms, or could harm the Services or other users.

SUBSCRIPTIONS AND BILLING

Certain features of the Services may require a paid subscription. If you purchase a subscription:

You agree to pay all applicable fees as described at the time of purchase

Subscriptions may automatically renew unless canceled before the renewal date

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period

Refunds are handled in accordance with our refund policy or the terms presented at the time of purchase

Payment processing may be handled by third-party providers such as Stripe. We do not store your full credit card information on our servers.

Your use of third-party services may be subject to their respective terms and conditions. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT ANY OUTPUTS, RECOMMENDATIONS, OR ANALYSES WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PARTICULAR PURPOSE.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEEKO AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, BUSINESS OPPORTUNITIES, SEARCH VISIBILITY, AI VISIBILITY, OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Peeko AI and its officers, directors, employees, partners, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Services, your violation of these Terms, your violation of any third-party rights, or any data or content you provide to the Services.

MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where appropriate, providing additional notice. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

TERMINATION

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will survive, including but not limited to intellectual property, disclaimers, limitation of liability, indemnification, and payment obligations.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
